TERMS OF SERVICE Last updated: October 26, 2026 1. OVERVIEW This website is operated by GO Gallery ("GO Gallery," "we," "us," or "our"). GO Gallery offers this website, including all information, tools, products and services available from this site (the "Services"), to you, the user, on the condition that you accept all terms, conditions, policies and notices stated here. By visiting our site or purchasing from us, you agree to be bound by these Terms of Service ("Terms"), including the policies referenced here and linked on our website, such as our Refund Policy and Privacy Policy. If you do not agree to these Terms, please do not use the Services. Our store is hosted on Shopify, which provides the online e-commerce platform that allows us to sell our products to you. 2. ELIGIBILITY AND ACCOUNTS By agreeing to these Terms, you confirm that you are at least the age of majority in your state or province of residence. If you create an account, you are responsible for keeping your login information confidential and for all activity under your account. Please notify us right away of any unauthorized use. 3. ABOUT THE ARTWORK Original and limited-edition works. GO Gallery offers original artwork and limited-edition prints by independent artists, most of them based in the Pacific Northwest. Edition sizes, media and dimensions are listed in each description as provided by the artist. Colors and appearance. We photograph every piece as accurately as we can, but colors and textures may look different on your screen. Hand-pulled prints and handmade works naturally vary, and slight differences in ink, paper, edges and registration are part of their character, not defects. Availability. Many works are consigned to us by the artists and may also be shown at exhibitions, pop-up events or other venues. If a piece sells elsewhere before your order is processed, we will notify you promptly and give you a full refund. Descriptions. We try to describe every work accurately. We do not warrant that product descriptions or other content on the site are complete, current or error-free. If an item is not as described, your remedy is to return it in accordance with our Refund Policy. 4. ORDERS, PRICING AND PAYMENT All prices are listed in U.S. dollars. Prices and availability may change without notice. We reserve the right to refuse or cancel any order, including orders that appear to be placed by dealers or resellers, or orders affected by an error in pricing, description or availability. If an item is listed at an incorrect price because of a typographical or system error, we may cancel the order and refund you in full, even after the order has been confirmed. You agree to provide current, complete and accurate purchase and account information, and to promptly update it as needed. Payment is processed securely through Shopify and its payment partners. Applicable sales taxes will be calculated at checkout. 5. SHIPPING AND RISK OF LOSS We carefully pack and ship every piece. Shipping times are estimates and are not guaranteed. Ownership of the physical artwork and risk of loss pass to you when the artwork is delivered to the shipping address you provide. If your artwork arrives damaged, please follow the instructions in our Refund Policy. 6. RETURNS AND REFUNDS Returns and refunds are governed by our Refund Policy, which is part of these Terms. 7. COPYRIGHT AND INTELLECTUAL PROPERTY Artwork. Buying artwork gives you ownership of the physical piece only. All copyright and reproduction rights remain with the artist. You may not reproduce, print, license or otherwise use images of the artwork commercially without the artist's written permission. You are welcome to share photos of your collection on social media with credit to the artist. Website content. All images, text, logos and other content on this website are the property of GO Gallery or its artists and are protected by copyright and other laws. You may not copy, reproduce, distribute or create derivative works from any content on this site without our written permission. 8. COMMENTS, REVIEWS AND SUBMISSIONS If you send us comments, reviews, suggestions or other submissions, you agree that we may use, edit and publish them in any medium without compensation to you. You agree that your submissions will not violate any third party's rights or contain unlawful, abusive or obscene material. We may, but are not required to, monitor, edit or remove any submission. 9. THIRD-PARTY SERVICES AND LINKS Our site may include links to, or tools provided by, third parties (for example, payment processors, shipping carriers or social media platforms). We do not control and are not responsible for third-party websites or services. Your use of them is at your own risk and subject to their own terms and policies. 10. PROHIBITED USES You may not use the site or its content: (a) for any unlawful purpose; (b) to violate any intellectual property rights, including those of our artists; (c) to harass, abuse or harm others; (d) to submit false or misleading information; (e) to upload viruses or malicious code; (f) to collect personal information about others; (g) to scrape, copy or harvest images or content; or (h) to interfere with the security or operation of the site. We may terminate your use of the Services for violating any of these prohibited uses. 11. DISCLAIMER OF WARRANTIES To the fullest extent permitted by law, the Services and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, except as expressly stated in these Terms or our Refund Policy. We do not guarantee that the site will be uninterrupted, secure or error-free. 12. LIMITATION OF LIABILITY To the fullest extent permitted by law, GO Gallery, its owner, artists, contractors and service providers will not be liable for any indirect, incidental, special, punitive or consequential damages arising from your use of the Services or any product. Our total liability for any claim related to a purchase will not exceed the amount you paid for that product. 13. INDEMNIFICATION You agree to indemnify and hold harmless GO Gallery, its owner, artists, contractors and service providers from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or the rights of a third party. 14. PRIVACY Your submission of personal information through the site is governed by our Privacy Policy. 15. CHANGES TO THESE TERMS We may update these Terms from time to time by posting the revised version on this page. Your continued use of the Services after changes are posted means you accept the revised Terms. The terms in effect at the time of your purchase apply to that purchase. 16. TERMINATION These Terms remain in effect unless terminated by you or us. You may stop using the Services at any time. We may suspend or terminate your access if we believe you have violated these Terms. Obligations and liabilities that arose before termination survive it. 17. GOVERNING LAW These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Services will be resolved in the state or federal courts located in Multnomah County, Oregon. 18. SEVERABILITY AND ENTIRE AGREEMENT If any part of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Refund Policy, Privacy Policy and any other policies posted on this site, are the entire agreement between you and GO Gallery regarding the Services.
